INTRODUCTION

These Terms of Service (the "Agreement") set forth the terms and conditions of your use of hosting and related services ("Services") offered to you by Surf Hosting (the “Service Provider”). The terms “we” and “our” may be used in this Agreement hereinafter by reference to the Service Provider.

We strongly suggest that you read through this Agreement as to enable you to understand the capacity to which we provide our Services.

By registering an account on the Service Provider’s system, it is assumed that you have read and can understand this Agreement. If you do not agree to this Agreement and all of the terms contained herein, you must not interact with any of the Services provided.

DESCRIPTION OF SERVICES
Surf Hosting provides website hosting services first and foremost. This constitutes us providing you the facilities to create and maintain a site and have it be accessible through the internet.

Surf Hosting provides game hosting as part of its services. You understand that provision of continuous service is subject to payment that has been accepted by us. Surf Hosting reserves the right to suspend service after an unpaid invoice. If payment is not provided, a suspension will be applied one (1) day after the first day of non-payment. After thirty (30) days, service may be terminated permanently. Surf Hosting may apply suspensions or terminations at our discretion, even out of these bounds.

You agree that all of the relevant Terms of Service/Use documents for other services incorporated by reference into this document are also expected to be followed at all times. For your ease of reference, we have integrated the most important terms into this Agreement.

As part of the domain registration process and in accordance with ICANN policies, a Registered Name Holder is required to submit, and update within seven (7) days of any change, complete and accurate information, including the following:

- the domain registrant's name and postal address;
- the domain being requested;
- administrative contact information, including the name, postal address, email address, and telephone number; and
- techincal contact information, including name, postal address, email address, and telephone number; and
- billing contact information, including the name, postal address, email address, and voice telephone number.

ASSURANCE OF PROFESSIONAL DILIGENCE
Surf Hosting asserts that it will act with professional diligence and will aim to resolve any disputes with you amicably. We agree to be held to the standard that our support representatives and any associated officials or agents will respond to queries with their best knowledge on the topic and will approach senior representatives if any disambiguation is required. Likewise, we expect that you will respect our support representatives and all officials that represent the Service Provider in an official capacity.In Surf Hosting’s marketing material, we may make reference to removing lag completely otherwise you will be issued a refund with a guarantee. While this is true and Surf Hosting will make every reasonable effort to honour this, the offer may be refused in instances where we find that there is dishonesty involved on your part, including deliberate deception. The decision will be final and cannot be disputed.

ACCEPTABLE USE
By using any service offered to you by us, you agree to being bound by this Acceptable Use Policy. It is designed to protect the interests of the company, its employees and other users of the services that we provide.

For the purposes of this document hereinafter, a “User” constitutes anyone who uses the services provided by Surf Hosting in any capacity, for any length of time, regardless of their intention(s) for doing so

You agree that you will keep your login credentials to any of our services secure and you will not give this information to any unauthorised individuals.. In the event that your login name and password is used by any unauthorised person, Surf Hosting accepts no responsibility and you will be liable for any damages incurred as a result of your negligence.

It is your sole responsibility to make regular backups of your data and files used in connection with the services. Even though Surf Hosting may make our own periodic backups for server maintenance purposes, we cannot be held responsible whatsoever for your data or files

You agree that you will not:
- perform any action that will reduce performance of our servers to the detriment of other users;
- upload any virus to Surf Hosting’s website which could infect our server or other equipment;
- allow a virus to enter the Internet by allowing Internet users to download files containing viruses or - knowingly or otherwise - from their website which is on our server;
- upload any material which infringes the intellectual property rights of any other party. We accept no responsibility for your actions in either uploading material to the Internet or in your transferral of any material to other websites (or vice versa);
- upload any material which may be considered to be contrary to public decency and morality including (but not limited to) pornographic, barbaric and overtly tasteless material. We reserve the right to randomly inspect the website and in the event that any unauthorised material has been uploaded to that website, we reserve the right to inform the relevant authorities and to terminate your access to the services forthwith;
- cause or permit or in any way assist in any unauthorised publication or any dissemination of defamatory material or any material which could be considered to be in breach of the civil or criminal laws of California;
- commit any act whereby access is gained by you to any information or resources of any person, body, corporate, individual, partnership, government agency, national institution, charity or recognised organisation without first having obtained authority from those persons or institutions;
- not to use our servers or network either directly or indirectly in a way that would have a detrimental effect on network performance; or
- do any act or omission the result of which would have the effect of bringing Surf Hosting into disrepute.

You are advised that, while we are able to offer unlimited bandwidth and storage to our customers, we reserve the right to delete excessive files such as large logs, redundant backups, or other files that the reasonable person could foresee a risk of impacting the node.

Surf Hosting also may apply a soft limit which is included but not limited to Web Hosting plans due to software constraints. It should, however, be noted that limits may be raised at any time by contacting our Customer Support team at support@surfhosting.co. In the event that the allocated bandwidth limit is reached, you agree to pay a charge of $3.50 per terabyte (TB) of usage that exceeds the monthly bandwidth limit. Otherwise, access to the service will be suspended until the subsequent payment period.

Surf Hosting employees should use approved encrypted communication methods whenever sending confidential information over public computer networks.

Only authorised cloud computing applications may be used for sharing, storing, and transferring confidential or internal information.

Information must be appropriately shared, handled, transferred, saved, and destroyed, based on information sensitivity. Employees should be careful not to allow unintended access.

Surf Hosting employees should not have confidential conversations in public places or over insecure communication channels, open offices, and meeting places.

Confidential information must be either by a Surf Hosting employee or courier approved by the Information Technology department.

All electronic media containing confidential information must be securely disposed of.

AVAILABILITY OF SERVICE
Surf Hosting understands and is sympathetic to the fact that there may be instances in which websites hosted by us may experience periods of downtime or unavailability. Surf Hosting accepts no liability for aforementioned periods of downtime and instead advises that you patiently wait for the downtime to pass as we are made aware. If the downtime persists after a period of twelve (12) hours, you may contact us for further assistance.

We will make every reasonable effort to assist with the issue, but you agree that we absolve ourselves of any liability for any potential further harm caused as a result of our intervention

You understand that Surf Hosting reserves the right to terminate access to any of the Services for any, or no, reason, though one may be provided in most circumstances at the discretion of the Service Provider. This may be due to unacceptable use of the Services

REFUND POLICY
Surf Hosting understands and is receptive to the fact that customers (“you”) may be dissatisfied with a product or service and, as a result, would like their money back, in return for access to the product or service being revoked.

This Refund Policy is intended to outline the specific circumstances under which you can ask for a refund from Surf Hosting, which we may abide by.

It is imperative that you read this Refund Policy and ensure that you have a sound understanding of it prior to making any transactions through Surf Hosting, whether it be a product or service, on a subscription or permanent basis.

You are advised that Surf Hosting may refuse a refund for any reason at any time, even if it would ordinarily be allowed under this Refund Policy. This right will not be invoked by Surf Hosting in the vast majority of situations.

Any subscription purchased by Surf Hosting as a service may be refunded. The entire amount of money paid will be refunded.

You are hereby advised that refunds will not be accepted under any condition where the product is a dedicated server, domain, or a product that is derivative of WHMCS Marketplace

For a refund to be accepted by Surf Hosting, the following conditions must be met:
- the right to invoke a refund under this Refund Policy must be exercised between zero (0) and forty-eight (48) hours since the transaction was processed; and
- the customer must have not invoked a refund under this Refund Policy before in their lifetime.

To invoke your right to refund a product or service offered by Surf Hosting, you must contact us at support@surfhosting.co or https://billing.surfhosting.co/submitticket.php, subject to the conditions as detailed above.

We strive to process a refund within fourteen (14) days from the request to refund being submitted to us. This accounts for us needing to check that you meet the conditions and that there are no exceptional circumstances that may necessitate us rejecting a refund.

INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Surf Hosting, Surf Hosting affiliates, and each of their respective directors, officers, employees, and agents from and against any and all third-party claims, demands, and liabilities, including reasonable attorneys fees, resulting from or arising out of: (i) any breach of your representations and warranties in this Agreement; or (ii) your failure to comply with your obligations under any and all laws, rules or regulations applicable to you under this Agreement, except to the extent such violation arises out of the Service Provider’s failure to comply with its obligations.

CHANGES TO THIS AGREEMENT
We may apply amendments (changes), omissions (removals), or addendums (more information) to this Terms of Service document at any time, for any, or no, reason. The Service Provider is required to make every reasonable effort to notify its users of significant changes to this Agreement at least thirty (30) days before changes come into effect. We reserve the right to make minor amendments, omissions, or addendums at any time, without prior notice. Because of this, we strongly advise that you revisit this document to ensure your understanding and agreement to these terms is sustained.

RIGHT TO DISAMBIGUATION
The Service Provider provides you the right to disambiguation, meaning that you can ask us for clarification about anything mentioned in this document and we can explain to you what it is intended to mean in simple, accessible English.

COMMITMENT TO ACCESSIBILITY
Surf Hosting is committed to providing a website that is accessible to the widest possible audience, regardless of technology or disability. We are actively working to increase the accessibility and usability of our website and in doing so adhere to many of the available standards and guidelines.

This website endeavours to conform to level Double-A of the World Wide Web Consortium (W3C) Web Content Accessibility Guidelines 2.1. These guidelines explain how to make web content more accessible for people with disabilities. Conformity to these guidelines helps make the web more user-friendly to all people.

While Surf Hosting strives to adhere to the aforementioned accepted guidelines and standards for accessibility and usability, it is not always possible to do so in all areas of the website.

TERMINATION
You, as well as the Service Provider, have the perpetual right to terminate this Agreement at any time, for any, or no, reason, without consequence. This does not invalidate any actions that may have been performed prior to the activation of this Termination clause. Terminating this Agreement also means that the Service Provider reserves the right to revoke your access to one or more of the Services.
